By downloading, installing, or using Band Mine Underground (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App. These Terms apply to all users of the App.
We may update these Terms from time to time. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
Band Mine Underground is a mobile application that uses artificial intelligence to suggest music artists based on seeds provided by the user. The App optionally integrates with Spotify to enable saving and playback. The App is provided free of charge, supported by optional rewarded advertising.
You must be at least 13 years of age to use the App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the App, you represent and warrant that you meet these eligibility requirements.
Digs are an in-app feature currency used to generate music discovery sessions. Digs have no monetary value, cannot be transferred between users, cannot be sold or exchanged, and are not redeemable for cash or any other consideration.
We reserve the right to adjust the Dig economy (starting balance, daily refill amount, ad reward amount, or maximum balance) at any time. Digs are stored locally on your device; we are not responsible for Dig balances lost due to device changes, app reinstallation, or data clearing.
The App offers optional rewarded video advertisements through Google AdMob. Watching an ad is entirely voluntary. By choosing to watch an ad, you agree to Google AdMob's terms and acknowledge that ad content is controlled by Google and its advertising partners, not by us. We are not responsible for the content of third-party advertisements.
The App's Spotify integration is built using the Spotify Web API and is subject to Spotify's Developer Terms of Service and Spotify's End User License Agreement. By connecting your Spotify account, you also agree to those terms.
We are not affiliated with, endorsed by, or sponsored by Spotify. Spotify availability and features are subject to change at Spotify's discretion. We are not responsible for any interruptions to Spotify services.
Artist recommendations in the App are generated by artificial intelligence. While we strive for accurate and relevant results, AI-generated content may occasionally:
The App is a discovery tool, not an authoritative music database. We encourage you to verify information through other sources before relying on it.
You agree not to:
The App, including its design, code, and branding, is owned by Band Mine Underground and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
Artist names, album artwork, and music content referenced in the App belong to their respective rights holders. We do not claim ownership of any third-party music content.
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the data practices described in the Privacy Policy.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any AI-generated content.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BAND MINE UNDERGROUND AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF DIGS, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.
Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed $10 USD.
You agree to indemnify, defend, and hold harmless Band Mine Underground and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.
We reserve the right to suspend or terminate your access to the App at any time, for any reason, including if we reasonably believe you have violated these Terms. Since all user data is stored locally, termination has no effect on data already on your device.
You may stop using the App at any time by uninstalling it.
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Band Mine Underground operates, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of that jurisdiction.
We reserve the right to modify, suspend, or discontinue the App or any feature at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the App.
